I acknowledge and agree that: (Class times and facilitators) Class times, days and facilitators are subject to variation at the discretion of Monkey Feet. (Payment) Payments are non-refundable. If my child misses a class I can arrange to attend another class the same week or in a subsequent week during the same term at the discretion of Monkey Feet but I am unable to obtain a refund. At least 3 hours notice must be provided to Monkey Feet to be able to receive make up sessions. Full payment is required in order to secure my child a place at Monkey Feet. (Supervision) 6 months to six year sessions I (or a carer whom I authorize) am required to attend all classes with my child and at no time can my child be left in the care of a Monkey Feet facilitator. I must take all reasonable care (or procure that my carer takes all reasonable care) to ensure the safety at all times of myself, my child, my carer (if any), Monkey Feet staff or any other person attending a Monkey Feet session. I shall have full responsibility for the safety, supervision and well being of myself, my child and my carer (if any) at all times during a Monkey Feet session or whilst on Monkey Feet premises. (Attendance when ill) I must not attend, or permit my child or carer (if any) to attend a Monkey Feet session when I, my child or my carer (as applicable) has a contagious illness. Monkey Feet reserves the right to remove any person from a class if that person is considered to be contagious or otherwise poses a health risk to other class attendees or to Monkey Feet staff. (Disruptive behaviour) Monkey Feet reserves the right to remove a child from the program if that child’s behaviour or that of their parent or carer (as applicable) is unmanageably disruptive to the facilitator and class. I agree to refrain from giving my child food during the course of a class. (Medical assistance) I authorise the obtaining of medical assistance as I/my child/my carer may require and agree to meet any expense relating thereto. (Intellectual property) All intellectual property rights in connection with Monkey Feet, the sessions run by Monkey Feet or any materials distributed by Monkey Feet remain the property of Monkey Feet and may not be used for any purpose (other than in relation to participation in Monkey Feet sessions) or reproduced without the prior written consent of Monkey Feet. (No liability) Neither Monkey Feet nor any Monkey Feet staff shall have any responsibility or liability to me, my child or my carer (if any), whether in contract, tort, statute or otherwise, for any loss, accident or injury suffered by me, my child, my carer (if any) or any other person in connection with a Monkey Feet session, the lawful actions of Monkey Feet or Monkey Feet staff or any other matter related to the business and activities of Monkey Feet. I will not make, and will ensure that neither my child nor my carer (if any) makes, any claim of whatever nature against Monkey Feet or Monkey Feet staff in breach of this term. (Indemnity) I hereby indemnify and hold harmless Monkey Feet for any loss or liability Monkey Feet may suffer as a result of any claim made by or on behalf of myself, my child or my carer (if any) in breach of the previous term. |
